Can a court require payment of non-reimbursed medical expenses in addition to child support?

A court in the State of New York may require payment of additional costs in addition to child support. For instance, a court may order a parent to pay for uninsured or non-reimbursed medical expenses. Specifically, uninsured medical expenses include medical expenses not covered by insurance. These expenses include co-pays, deductibles, prescriptions, and other medical, dental, and vision costs. Critically, the cost must be the result of a “medically necessary treatment or procedure.”

To order a parent to pay for the cost of unreimbursed medical expenses, a child support order must stipulate the parent is required to pay for such expenses. It is very important to review the child support order and make sure that such a provision is included.
