“In New York, what is a Definite Sentence?”

A definite sentence is for a flat one number length of time but must be for one year or less. Under New York’s Penal Law 70.30.4 (b), a prisoner may earn good tie credit for up to 1/3 of the term. While most definite sentences are served at one continuous time, under New York’s Penal Law 85, it is also possible to serve a definite sentence as an intermittent (often imposed as a “weekend”) sentence.
